1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of the mobile applications and related SMS/text messaging services (collectively, the "Services") operated by Brandon James ("we," "us," or "our"). By downloading, installing, accessing, or using any of our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

2. Our Services

We operate the following mobile applications and associated services:

2.1 Bintu

Bintu is a social connectivity platform that helps friends see when each other is available for phone calls. Bintu uses your phone number, contacts, Bluetooth, and location data to provide its core features, including friend discovery and availability status sharing.

2.2 Sunshyne

Sunshyne is a weather application that provides weather information for your current location and planned travel destinations, along with intelligent packing list generation based on weather conditions, trip activities, and personal preferences. With your explicit consent, Sunshyne accesses your device’s calendar to extract location and date information from your upcoming events, enabling it to detect trips and provide weather forecasts for your destinations. Raw calendar event data is not permanently stored on our servers; however, derived trip data (such as destination cities and travel dates) is stored to support trip detection and weather planning features. Sunshyne also uses your location data to deliver accurate, localized weather information. Sunshyne does not require account creation, does not collect your phone number, and does not use SMS messaging.

3. SMS/Text Messaging Program (Bintu Only)

Program Name: Bintu Account Verification

Program Description: The SMS/Text Messaging provisions in this document apply exclusively to Bintu. Sunshyne does not use or collect data for SMS messaging. When you create an account, log in to Bintu, or initiate a forgotten password reset, you may receive a one-time SMS verification code to authenticate your identity or verify your request. These messages are transactional in nature and are sent solely for the purpose of account verification and password recovery. No marketing or promotional messages will be sent via SMS. Additionally, Bintu allows you to invite friends from your contacts via SMS through your device’s native messaging app. These invitation messages are sent directly from your device and are not transmitted through our messaging service. When you invite a friend, their phone number and name are stored on our servers to enable automatic friend connection when they join Bintu.

Message Frequency: 1 message per login, verification, or password reset attempt. Message frequency varies based on your account activity.

Message and data rates may apply. Your carrier’s standard messaging and data rates will apply to any messages you send to or receive from us. Please contact your wireless carrier for details about your messaging plan and any applicable fees. We are not responsible for any charges incurred from your carrier.

3.1 Opt-In / Consent

By providing your mobile phone number during account registration within the Bintu app and initiating a login, account verification, or forgotten password reset, you expressly consent to receive transactional SMS messages from us containing verification codes. When you request a password reset, the app will inform you that a verification code will be sent to your phone number before the message is dispatched. Your consent to receive text messages is not a condition of purchasing any goods or services.

3.2 Opt-Out Instructions

You can cancel the SMS service at any time. Simply text STOP to the number from which you received the message. After you send the text message STOP to us, we will send you a confirmation message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to receive messages again, you may opt back in by initiating a new login/verification request within the app.

3.3 Help / Support

If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly by contacting us at brandonisaacjames@gmail.com.

3.4 Carrier Liability

Carriers (including but not limited to T-Mobile, AT&T, and Verizon) are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network carrier and is outside of our control.

3.5 No Sharing of Messaging Data

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4. User Accounts

To use Bintu, you are required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary. You must notify us immediately of any unauthorized use of your account. Sunshyne does not require account creation. Sunshyne identifies your device anonymously using a device-generated identifier and does not collect your phone number, email, or any login credentials.

5. Acceptable Use

You agree not to use our Services to:

  • Violate any applicable local, state, national, or international law or regulation.

  • Transmit any content that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.

  • Impersonate any person or entity or misrepresent your affiliation with a person or entity.

  • Interfere with or disrupt the Services or servers or networks connected to the Services.

  • Attempt to gain unauthorized access to any portion of the Services or any other systems or networks.

  • Use the Services for any purpose that is fraudulent or otherwise unlawful.

6. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Brandon James and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.

7. Disclaimers

Our Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

Weather information provided by Sunshyne is for informational purposes only and should not be relied upon as the sole basis for making decisions that could affect personal safety. Always consult official weather sources for critical weather-related decisions.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Brandon James shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the Services.

9. Account Deletion

For Bintu, you may delete your account at any time through the app settings or by contacting us at brandonisaacjames@gmail.com. Upon account deletion, we will delete or anonymize your personal data in accordance with our Privacy Policy. Deletion of your account will also unsubscribe you from any SMS messaging services associated with your account. For Sunshyne, which does not use accounts, you may request deletion of all data associated with your device by contacting us at brandonisaacjames@gmail.com. We will process such requests within 30 days.

10. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Alameda County, California.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of these Terms and, where appropriate, notify you through the Apps. Your continued use of our Services after any changes constitutes your acceptance of the updated Terms.

13. Privacy Policy

Your use of our Services is also governed by our Privacy Policy, which is available at foac.info/privacy-policy. The Privacy Policy describes how we collect, use, and protect your personal information. By using our Services, you consent to the practices described in the Privacy Policy.
